These terms and booking conditions govern the operations of I ♡ Comino Boat Charters (“our”, “we”, “us”). Please review these terms carefully as they delineate our respective rights and responsibilities. By requesting confirmation of your booking, we are entitled to presume that you have had the chance to read and understand these booking conditions, and consent to them.

 

General Conditions & Liabilities

• Boat services and itineraries are subject to change in the event of severe weather conditions or disruptions reported by Notice to Mariners Malta.
• Your booking implies your consent to comply with our terms and conditions, inclusive of our Waiver conditions.
• We are not liable for injuries, sickness, accidents, schedule alterations, or any other occurrences resulting from weather conditions, natural disasters, strikes, or other unforeseeable circumstances beyond our control.
• Our skipper always prioritizes safety and holds the authority to make final decisions regarding onboard safety.
• I ♡Comino Boat Charters holds no liability for personal injury or damage, regardless of its cause, before, during, or after the trip, tour or charter service.
• Parents or guardians are responsible for children’s supervision. Children under 4 years old must sit on their parents’ laps, with the option of requesting a life jacket.
• In the event of force majeure preventing I ♡Comino Boat Charters from fulfilling its obligations, no restitution or compensation is guaranteed.

 

Private Boat Charter Services

• All private boat charter services include a professional skipper.
• Pricing is per boat, not per person, and is determined by factors such as boat size, charter service, and group size.
• Customization of charter services and itineraries is available through direct contact with us.
• Our skipper reserves the right to alter the sequence in which the tour visits places of interest and hidden gems.
• At I ♡Comino Boat Charters, all services are conducted on open boats. It’s advisable to check the weather in advance and consider bringing a jacket or hoodie for cooler days, particularly during late afternoon or early morning charters.
• Upon booking, we will confirm your preferred time and recommend arriving early to prevent any delays. Please ensure you are present at the departure meeting point at least 10 minutes prior to departure. This ensures a punctual start to your trip, as any waiting time for late arrivals cannot be added to the end of the trip.
• Smoking is permitted on private charters, as our boats are open.
• During charter services, alcohol consumption is permitted onboard, provided it is done responsibly.
• Small dogs are permitted on the trip and can sit on your lap or under the bench.
• Our boats are not designed to accommodate wheelchairs.
• Clients should board the boat by stepping from the quay onto the vessel.
• While there are no onboard restroom facilities, toilets can be found at each meeting point, as well as at the Blue Lagoon and at select stops across Malta and Gozo islands.

 

Passenger’s Personal Belongings & Liabilities

• At I ♡Comino Boat Charters, we advise clients to be responsible for their personal belongings during the tour.
• Please be aware that I ♡Comino Boat Charters is not responsible for any lost, stolen, or damaged personal belongings during our tour service.
• The passenger is liable for any damages caused to the property or goods belonging to I ♡Comino Boat Charters or third parties.
• All activities and services arranged by I ♡Comino Boat Charters are undertaken at the passengers’ own risk.

 

Our Liabilities

• I ♡Comino Boat Charters bears no responsibility for any damage or loss of passengers’ personal belongings.
• All personal belongings brought on board by passengers during the tour are entirely at their own risk, and they are responsible for them.
• I ♡Comino Boat Charters holds no liability for any damages to passengers or their belongings incurred while boarding boats, jetties, or participating in other activities provided by us.
• Entry into these areas signifies that clients and passengers accept all associated risks.

 

Special Deals & Codes

• Kindly be aware that promotional codes and similar special offers cannot be retroactively applied to reservations after purchase, including through refunds.
• I ♡Comino Boat Charters special offers cannot be combined with any other sale, code, promotion, coupon, discount, or offer.
• Codes and coupons are only applicable for direct bookings with I ♡Comino Boat Charters.
• Ensure that any special deals or promotional codes are entered during the booking process, specifically on the payment page at checkout, to validate their eligibility.
• Special deals, offers, discounts, and promotional codes are applicable solely to the tour price and do not cover any additional extras.

 

Meeting Points Delays

• The skipper has the discretion to decide whether to proceed with sailing or cancel if group clients arrive late. Please note that waiting time is considered part of the sailing time, and cannot be appended to the end of the trip in the event of late arrival.

 

Payment Terms & Cancellation Policies

• I ♡Comino Boat Charters offers outdoor water activities that are subject to weather conditions, and our experienced team, along with the skipper, prioritizes your safety above all else. We select the finest locations based on weather conditions, and if inclement weather necessitates the cancellation of an activity or service, you will be provided with the option of rescheduling or receiving a refund.
• Refunds will not be granted for reasons such as lack of desire to participate in the tour, inability to equalize, seasickness, dissatisfaction with the weather, personal health issues, or any other circumstantial or personal situations beyond our control.
• For group bookings, upon agreeing to our offers and discounts, we will initially confirm the booking and subsequently issue an invoice within two days. Payment for the invoice must be settled prior to the trip.
• Cancellations must be made ina written form only.
• Full refunds will be issued if the tour, trip, or charter is cancelled at least 48 hours in advance.
• No refunds will be provided for cancellations made less than 48 hours in advance.

 

Contract Execution

• Legitimate grounds for voiding the contract include adverse weather conditions, such as severe storms or high water levels, which obstruct or render the cruise impracticable. The skipper initially assesses whether such circumstances are present.
• I ♡ Comino Boat Charters prohibits the consumption of alcohol by individuals under the age of 18 and reserves the right to ask for a photo ID to verify age.
• If misconduct occurs, regardless of whether it is linked to alcohol consumption, the skipper retains the authority to temporarily pause or terminate the trip immediately. Individuals who are already under the influence of alcohol or drugs at the commencement of the tour will be refused entry onto the boat. The customer remains obligated to fulfill their payment obligations.
• All clients and passengers are required to promptly follow instructions given by I ♡ Comino Boat Charters, the skipper, or other staff members.
• Access to boats and jetties may be declined without justification if deemed necessary by I ♡Comino Boat Charters. This determination may be influenced by factors like capacity, safety, public order, or the potential for damage or disruption.

 

Complaints

• If there are any concerns regarding the agreement execution, the participant should promptly inform I ♡ Comino Boat Charters to facilitate the identification of an appropriate solution. If the issue is not resolved within a reasonable period, especially if it affects the activities or arrangements quality, it should be reported to I ♡ Comino Boat Charters without delay.
• If the complaint is not promptly resolved, it can be formally lodged in writing with I ♡ Comino Boat Charters within 14 days after the conclusion of the arrangement or activity. The complaint should provide a thorough description of the encountered issues.

 

Changes to these Terms & Conditions

• We retain the right, at the sole discretion of I ♡Comino Boat Charters, to amend or substitute these Terms at any time.
• In the event of a significant amendment, we will make reasonable efforts to provide a notice period of at least 30 days before the implementation of any new terms.
• The determination of what constitutes a significant change will be made solely by us.
• By continuing to access or utilize our service after such revisions come into effect, you agree to abide by the updated terms. Should you disagree with the new terms, either in part or in full, please cease using the website and the service.

 

Concluding Provisions

• Passengers are required to adhere to crew instructions on the quay, jetty, and boat. For hikes or snorkel tours, guidance will be provided by a professional skipperprior to the tour’s commencement.
• It is strongly advised against wearing stiletto heels due to safety concerns and potential damage.
• Passengers are responsible for preserving the environment and must refrain from disposing of waste in the water or natural surroundings. All personal consumption items and associated waste must be removed from the boat at the conclusion of the trip.
• I ♡ Comino Boat Charters will not be held liable for obvious errors or inaccuracies in the information provided or published by the company.
